女模不滿肖像遭濫用　廣告商判賠36萬元

【張欽／台北報導】廣告女模張薰仍（藝名張虹），前年10月以友情價6萬元拍「遠傳電訊-Rhyme」廣告，她不滿片商博宇堂與代理商奧美廣告違約，擅自擷取影像用於平面廣告，憤而提告求償30倍違約金共180萬元，台北地院認定2公司違約，審酌後判賠張女36萬元，全案可再上訴。
 
博宇堂與奧美公司辯稱，自2005年起就與張虹合作拍攝遠傳系列廣告，前年10月再度合作拍攝「遠傳電訊-Rhyme」廣告，因遠傳要求視覺一致，又臨時要求使用擷取單張影像，因時間緊迫且合作多年而善意配合，事後也提出賠償5倍費用表示歉意，並繼續合作一年，絕無惡意違約。
 
法官認為，雙方合約規定，拍攝影像只能用於台灣地區電子全媒體含網路，增加使用範圍或剪接肖像使用，須經張虹同意並額外收費，違約要賠30倍酬勞共180萬元，但博宇堂與奧美擅自剪接肖像用於《蘋果》等報紙及門市海報，顯然違約，審酌後判博宇堂、奧美要連帶賠張女36萬元。
