電話中譙你娘　公然侮辱起訴

【夏至賢／綜合報導】男子林松霆不滿湄江旅行社吳姓業務代訂機票出錯，到旅行社找不到人出氣，當場打電話飆罵吳男「幹你娘、你娘卡好！」等髒話，不料挨告。北檢查出，林男雖透過電話罵人，但有多名旅行社員工聽見林男罵三字經，也知道被罵的是吳男，認定林男觸犯公然侮辱罪，昨將他起訴。

今日出刊的《蘋果》報導，吳男昨不在辦公室，湄江旅行社老闆符澤泉說：「我們已坦承疏失卻仍挨罵，提告只是討個公道。」林男則聯繫不上，不知其回應。

律師施宣旭指出，所謂「公然」，指的是不特定人或多數人得以共見共聞的狀況，也因此在電話中罵人，通常因通話內容僅雙方知道，不會構成公然侮辱，但若罵人聲音過大，導致他人聽見內容，且知悉被罵對象，就可能觸法。
