被撞到腰椎間盤突出　婦人獲賠164萬元定讞

【劉昌松／台北報導】高雄柯姓女子前年騎車超越前方騎士時，不慎發生擦撞，導致李姓女騎士人車倒地，送醫治療後，發現腰椎受傷，並有腰椎間盤突出等後遺症，生活不便，最高法院最近判柯要賠償李164萬多元定讞。

判決指出，2011年4月間，柯女在高雄市仁慈六街超車時，因沒保持安全距離，擦撞右方李姓女騎士，柯因此被依過失傷害罪判刑4月，得易科罰金定讞。民事部分，雖柯質疑車禍不至於害人椎間盤突出，但法官調查李之前並無相關病史，反而是車禍後，多次因下肢無力等症狀就醫，才被檢查出是椎間盤突出。

高雄高分院考量李婦雖無業在家，但較為吃重的家務都得由丈夫代勞等情形，認定柯應賠償李婦勞動減損、精神損失共171萬元，扣除已經理賠的強制責任險後，李還可獲賠164萬餘元，案經最高法院駁回上訴定讞。
