弒親驚世媳婦不服判死　聲請釋憲失敗

【丁牧群／台北報導】南投驚世媳婦林于如因沉迷六合彩積欠大筆債務，以推下樓及下毒等方式，陸續殺死親生母親、婆婆與丈夫，詐得保險金505萬元，她因為殺母、殺婆婆的犯行，去年被判處2個無期徒刑確定；殺夫部份，今年6月被最高法院依殺人等罪判死刑定讞，成為台灣23年來首名女死囚。
 
但林于如主張自己智能不足又有重度憂鬱症，最高法院卻認為她的狀況未達《刑法》第19條「精障或心智缺陷，導致欠缺辨識能力者不罰」、「精障或心智缺陷，導致辨識能力顯著降低者得減刑」，林女主張《刑法》第19條恐違反《兩公約》「心智障礙者，不問障礙程度，均不得判處死刑」規定，也違反《憲法》第15條保障人民生存權之意旨，因此聲請釋憲。
 
但大法官會議今決議「不受理」林女的聲請釋憲案，理由是大法官會議受理釋憲案的要件之一，必須是確定終局裁判所適用的法律或命令有牴觸《憲法》之虞，但最高法院判決林女殺人案，並未適用《刑法》第19條，因此林女的主張不符合聲請釋憲條件。
