少女下體驗出精液　男竟辯浴缸內有精子

【許淑惠／台中報導】中市呂姓男子(20歲)去年6月與網路認識的13歲少女相約見面，帶少女至汽車旅館發生性關係，3天後少女告訴老師，於少女外陰部驗出呂男的精子ＤＮＡ，呂男辯稱與少女先後進入同一浴缸水內泡澡，才會沾到他的ＤＮＡ。
 
一審法院函詢刑事警察局，是否有可能發生如呂男所稱泡澡時精子沾陰部情形？刑事警察局回覆，同一缸水內泡澡，3天後驗出精子ＤＮＡ的機率極低；台中高分院指出，除了刑事局函覆外，呂男自陳未於浴缸內自慰，少女陰部不可能檢出ＤＮＡ的可能，認定2人確實發生性關係，呂男明知少女未滿14歲，犯後還卸責矯辯，判刑4年6月。
