稱開房間洗衣服　警當小王判刑定讞

【王吟芳╱高雄報導】保六總隊柯姓警官與羅姓人妻到汽車旅館開房間，羅女的翁姓丈夫報警捉姦並提告，柯男、羅女一審被依通姦罪各判刑4月及3月，兩人上訴喊冤，羅女還拿出診斷書稱自己罹「菜花」不可能與柯男有性行為，但二審綜合現有事證研判兩人有通姦事實，駁回上訴判有罪定讞。
 
法院審理時柯、羅均否認通姦，辯稱當天在車上談事情時，羅女喝啤酒不慎潑灑在身上，才就近到歐閣汽車旅館清洗；且房內衛生紙團僅驗出羅女體液，沒有通姦直接證據等。
 
但法官依據兩人在旅館內一待就是90分鐘、房內兩個保險套只剩空盒、柯男一出旅館見到羅女之夫就立即道歉等情況證據，認為依一般社會經驗，加上柯男身為警官，羅女也是人妻，相偕上汽車旅館僅為清洗衣服酒漬，令人難以相信，足以認定有通姦行為，因此將上訴駁回，判柯男有期徒刑4月，羅3女月定讞。
