與15歲少女防火巷嘿咻 男網友判10月

張姓男子在網路認識15歲少女，兩度見面都在防火巷裡嘿咻；事後少女懷孕，跟媽媽說被強暴。法官勘查，認為防火巷很窄，二人無法並肩走進去，地上又都是水管，少女躺在地上，屁股卻未受傷，顯然不是強暴，昨天判決張姓男子有期徒刑10月。

判決書指出，張姓男子（23歲）前年在網路聊天室認識少女，前年8月約她到台中市高鐵站看中區資訊展，他從台南搭高鐵來到烏日站，看展後他送少女回彰化市住處，在書局旁的防火巷內發生性行為。兩周後，兩人相約，又在防火巷內發生關係。一個多月後，少女發覺懷孕，在母親逼問下，她說被網友強暴，她母親提告。

法官指出，防火巷很窄，張男有左手障礙，但少女兩次都未呼救；防火巷地上都是水管，少女供稱被壓在地上性侵，臀部卻未受傷，也不合常理。事後，她還傳簡訊給張男，一起到藥局買驗孕棒，少女指控被強暴，顯然與事實不符。但少女未滿16歲，仍依妨害性自主，判決張姓男子有期徒刑10個月。
