酒後睡車上　無法證明酒駕不起訴

【石明啟／桃園報導】中壢朱姓男子（38 歲）去年7月酒後趴在方向盤呼呼大睡，警方到場發現車子引擎正發動，懷疑他酒駕，酒測值為0.73，依公共危險罪嫌送辦，但檢方認為沒有證據證明有駕駛行為，獲不起訴處分，不得再議。
 
警方表示，朱男被逮後坦承在中壢市普忠路1家餐廳喝酒，趴睡地點則是新中一街，兩地距離約800公尺，研判有酒駕行為，但朱男稱酒後搭友人車子返家，因天氣太熱跑到車上吹冷氣，並沒有駕駛行為。
 
檢方認為，酒後危險駕駛需實際操控交通工具，朱男被查獲時無法證明駕駛行為，餐廳附近監視器因夜間光線不足，也無法確認車子是否移動過。
