與妻爭監護權　副教授略誘2子判緩刑定讞

【劉昌松／台北報導】中部某大學副教授因和德籍妻子長期分居2地，感情不睦，副教授竟在與妻子進行離婚、孩子監護權訴訟時，將2名兒子帶離住處，隔絕妻子與孩子的聯繫，被最高法院依略誘罪判刑8月，緩刑2年定讞。

判決指出，副教授和妻子在2000年結婚後生下2子，2007年起，副教授陸續將2子帶回台中居住，妻子則在2010年從德國返回台中，開始為離婚與監護權打官司，而副教授卻在隔年某個週末，將2子帶走，連住了3晚的汽車旅館，之後還將孩子送到舅公家去住，妻子因聯繫不到孩子，多次報警，法官認定副教授觸犯《刑法》略誘罪。

但法官考量全案來龍去脈，避免孩子因成人世界的錯誤觀念與怨憤紛爭，導致難以回復的傷害，不要讓孩子在對簿公堂的過程中，承受親情的撕裂及仇恨的傷害，因此給予副教授緩刑機會，案經最高法院駁回上訴定讞。
