竹筷戳破獄友左眼致死　毒蟲判9年2月定讞

【劉昌松／台北報導】毒蟲黃俊琪去年7月因吸毒在監服刑時，因和獄友張志賢吵架，竟拿竹筷朝張的臉部連戳2下並一陣拳打腳踢，張因眼球破裂加上頭部被打到內出血不治死亡，最高法院依重傷致死罪判黃徒刑9年2月定讞。

判決指出，黃去年7月在監獄工廠內和張起口角後，被張從後踹中腰部，黃一怒之下，轉頭拿著攪拌咖啡用的竹筷戳向張男左眼眶，導致張眼球破裂後，黃仍不放手，再繼續對張拳打腳踢，直到管理員上前拉開，張男被緊急送醫不治死亡。

高院審理認為，黃在監獄裡不自我反省，僅因遭攻擊，就拿竹筷猛戳他人頭部重要部位，雖無殺人犯意，仍依重傷害致死罪判他徒刑9年2月，同時沒收凶器竹筷1隻。案經最高法院駁回上訴定讞。
