蔡正元提案《首都法》　釣魚台屬首都轄區

【何哲欣／台北報導】教育部日前一紙公文說中華民國首都在南京引發爭議，國民黨立委蔡正元今說，為解決相關爭議，將提「中華民國首都法草案」，明文規定自1950年1月1日起，中華民國首都為台北市，且「中央政府所在地」應設於「首都」，讓兩個法律概念合一，消除疑義，另外也將釣魚台改列為首都轄區，提升主權訴求之位階，不讓日本東京都的訴求佔上風。

蔡正元也在他的臉書公佈草案內容（http://ppt.cc/q76B）。他說，美、中、韓等國都有法律明文規定首都所在地，因此希望我國也立法，否則我國首都在哪，只以經不起考驗之行政命令或行政官員口頭說明，相當不莊重，也非法治國家應有作法。
 
據蔡正元版本，中華民國首都之轄區，同台北市行政轄區；中華民國總統府、行政院、立法院、司法院、監察院、考試院之本部，都應設在中華民國首都。未來其他周邊縣市若要併入首都轄區，也可經當地居民舉行公民投票通過，由台北市政府核定，提交台北市議會審議通過後，向行政院核備。
