嘉泥前董座內線交易　繳3927萬換緩刑定讞

【劉昌松／台北報導】上市公司嘉新水泥前董事長張永平，6年前在確認台泥香港子公司將併購嘉泥香港子公司後，大量買進嘉泥股票，等消息公布後賣出獲利275萬元遭起訴，因張已全數繳回犯罪所得，最高法院依內線交易等罪判他徒刑1年半，緩刑3年，緩刑條件是繳庫3927萬元定讞。

嘉泥是國內老牌水泥廠，由張永平的父親張敏鈺所創立，而張永平在案發後已經辭去嘉泥董座職務，目前因病接受治療中。

判決指出，張永平在2007年間，和台泥負責人辜成允多次開會，確認2公司的香港子公司併購案後，張永平卻在此重大利多消息公告前，指示部屬以每股19.3元到19.8元不等價格，大量買進嘉泥股票，等消息公布後，再以平均24.5元價格賣出，獲利達275萬9962元。

台北地院審理時，考量張永平坦承犯行，且主動交出犯罪所得，又因病在和信治癌中心接受治療，因此判他徒刑1年半外，給予緩刑3年機會，並要繳庫3972萬元，案經上訴二、三審都遭駁回定讞。
