臉書罵吃蠟燭 遭判公然侮辱

高市鄭姓男子對友人不滿，竟在友人的臉書貼文辱罵「幹，你好醜」，還在朋友照片留言「吃蠟燭啦」、「吃元寶啦」字句，遭朋友提告；高雄地方法院判鄭男涉嫌公然侮辱罪，處拘役25天，可易科罰金。

法官認為，「吃蠟燭」、「吃元寶」，依照社會民間習俗，是「鬼」做的事情，依照一般社會通念，「鬼」有「惡劣」、「糟糕」、「討人厭」或「讓人避之唯恐不及」等含有輕侮、鄙視，讓被害人在精神、心理上感覺難堪，過程中還夾雜「幹」，更是讓人難堪穢語。

判決書指出，鄭姓男子辯稱，他在臉書的發言，僅是單純個人心情抒發，沒有侮辱對方的意思。法官卻認為，鄭男藉這些描述，貶損被害人名譽、人格與社會評價。

判決書指出，鄭姓男子和友人交惡後，對友人心生不滿，今年1月下旬某天深夜，在友人臉書刻意發表辱罵文字「幹」，並在友人分享吃火鍋照片，留言「吃蠟燭啦」、「吃元寶啦」，意指對方與鬼無異的文字留言，遭友人提起公然侮辱告訴。
