扛屍性侵辯對方不要夜渡資　男遭判3年2月

【鄧玉瑩／台中報導】1名吳姓大學生(19歲)3年前與朋友在台中某PUB喝完酒後，發現1名酒醉女子獨自1人躺臥PUB門口，意識不清，竟與友人「扛屍」回租屋處，脫掉女子內衣內褲，戴上保險套性侵。一審時，法官考量吳坦承犯行，一再表明要與女和解，依妨害性自主罪判1年10月，緩刑5年。
 
但到了二審，雙方仍未和解，吳辯稱要給女子「夜渡資」1萬元，是對方不要，且當晚女子自稱「傳播妹」，自願到他租屋處，他打開女子背包，發現有保險套，認為女子酒後有性需求，才在好奇心驅使下和她發生性關係。

但台中高分院法官認為，吳犯後毫無悔意，竟以輕蔑語語蓄意攻擊被害人，改判3年2月。目前吳輟學入伍服役中，全案仍可上訴。
