二、依刑事訴訟法規定，不服下級法院之判決，得向上級法院提起上訴，即享有上訴權者何人？又下列之上訴程序，是否合法？倘其上訴程序存有瑕疵，法院應如何處理？（25％）
（一）被告為民國七十年十月二十日出生，所犯竊盜罪經第一審判處罪刑。判決正本於九十年九月三十日收受送達；被告之父某甲不服該項判決，於同年十月十八日提起第二審上訴，第二審法院於同月十九日收受該上訴書狀。此項上訴第二審能否為實體裁判？
（二）被告為成年人，所犯詐欺罪經地方法院判處罪刑後，被告之原審選任辯護人 A 律師，以自己之名義為被告之利益，向高等法院提起上訴。但上訴書狀未列被告為上訴人。此項上訴是否合法？高等法院應如何受理本件上訴？
