| 食品攙偽 最重關5年

立法院社會福利及衛生環境委員會今天初審通過食管法部分條文修正草案，提高食品廠商攙偽刑責為五年，並沒收犯罪所得利益。
黑心食品議題引發社會關注，行政院及朝野立法委員紛紛提案修法，經過多次討論，晚間終於完成食品衛生管理法修法初審，但部分爭議條文，如增設食品安全保護基金、明定檢舉獎金等仍無共識。
初審通過，食品廠若攙偽、假冒、添加未經主管機關許可添加物者，從現行處三年以下有期徒刑、拘役或科或併科新台幣八百萬元以下罰金，改處五年以下有期徒刑、拘役或科或併科八百萬元以下罰金。
在法人或自然人方面，初審通過條文也明定，若法人或自然人的代表人或從業人員因執行業務攙偽、假冒，除處罰行為人，對法人或自然人也科以各該項十倍以下罰金，亦即最高可處八千萬元以下罰金。
若食品廠沒被科以刑責，初審通過食品廠商攙偽或假冒，處六萬元以上五千萬元以下罰鍰；情節重大者，得命其歇業、停業、廢止其公司、商業、工廠登錄，且一年內不得重新登錄。
