【黃揚明／台北報導】國防部最高軍事檢察署檢察長曹金生今開記者會公布洪仲丘偵查結果，其中還爆出案外案。陸軍269旅禁閉室管理士陳嘉祥在本月1日上午操練禁閉生林政彥時，有11分鐘殘酷虐待情節，因偵辦洪案發覺案情，主動立案偵辦，將陳依上官藉勢凌虐軍人罪起訴，並要求從重量刑。

曹金生說，陳嘉祥當天基本教練操練後，在烈日下要求林政彥抬頭仰望天空約5分鐘，隨後要求他出列，背靠訓練場圍牆半蹲、雙手上舉裝水鋼杯，並放2本佛經在林大腿上，要求水不得溢出、佛經不得掉落，否則要再處罰，足使人達到肉體上不堪忍受、有殘酷虐待之感。

國防部公布「國防部高等軍事法院檢察署起訴書節本」全文，針對269旅禁閉管理未依規定處理查處如下：
 
 壹、犯罪事實

郭毓龍係陸軍機械化步兵第二六九旅旅部及旅部連中尉憲兵官，負責禁閉室管理及內部生活管理等業務，具拘禁人犯職務之責，緣自99年8月1日起奉派擔任該管憲兵官迄今，查陸軍第六軍團指揮部令頒「禁閉（悔過）室實施規定」，為集中管理禁閉（悔過）人員及精簡戒護、管理人員兵力，該部禁閉（悔過）室（下簡稱禁閉室）統一設置於陸軍機械化步兵第二六九旅（下簡稱陸軍二六九旅），其他旅級單位禁閉（悔過）人員均由陸軍二六九旅禁閉室代管，並採任務編組方式，每季自軍團所轄單位指派適員輪流擔任管理人員及戒護人員；為加強負責管理、督導、教化之責，前經陸軍二六九旅旅長楊方漢少將下達職務命令，須經其批准後始可移送禁閉室施予處分，室內設置鐵柵門、窗等外圍阻絕設施以加強管控，防止人員脫逃，以達訓悔違犯軍紀營規之士官兵，強化心輔與教化效果。詎被告明知依前揭命令，移送禁閉（悔過）之處分須經旅長批准後始可執行，惟被告竟基於職務上之方便，分別於（一）102年6月14日9時即移送陸軍後勤學校之二等兵葉○○至禁閉室執行禁閉處分，然葉員之移送執行案於102年6月17日15時15分始簽奉旅長批准；（二）102年6月28日10時16分即移送陸軍裝甲第五四二旅旅部連下士洪仲丘至悔過室執行悔過處分，然洪員之移送執行案於102年6月28日16時40分始簽奉旅長批准；（三）102年6月28日11時20分即移送一等兵宋○○至禁閉室執行禁閉處分，然宋員之移送執行案於102年6月28日16時40分始簽奉旅長批准執行。郭員為圖管理上之便利，竟基於限制前揭人犯行動自由之犯意，尚未經旅長批准執行前即先後將前揭三員禁閉（悔過）生移送執行，違法禁錮禁閉（悔過）生，案經國防部高等軍事法院檢察署與本署共同組成洪仲丘死亡案專案小組調查，經該署偵辦他案後查覺上情，因認被告涉有瀆職罪嫌，且階級為中尉，非屬該署管轄案件，遂移本署偵辦。

貳、所犯法條

被告郭毓龍於前揭時、地奉命擔任該管憲兵官，為擔任禁閉室管理之人，於任職期間未經權責長官批准而移送執行禁閉（悔過）處分之行為，顯已分別觸犯陸海空軍刑法第76條第1項第2款、刑法第134條、第302條第1項之「公務員假借職務上之權力，以其他非法方法，剝奪人之行動自由」3罪嫌。
