| 企業代扣工會會費 免經個別會員同意

【陳嘉恩／台北報導】《工會法》規定企業工會經會員同意後，僱主需自勞工薪資中代扣會費轉交給工會，以往工會需蒐集個別勞工同意書後轉交資方代扣薪資，時常造成麻煩、衍生爭議。勞委會近日發布解釋令，即起只要企業工會經過會員大會或會員代表大會決議、或訂定在工會章程和團體協約中，或勞資雙方原本就已有代扣會費的慣例，即視為法令中所說的「會員同意」，僱主就有協助代扣會費的義務。
勞委會指出，縱使個別會員另行出具書面給資方要改為自行繳納會費，資方也不能停止代扣，除非會員退費或出會，才不需再代扣會費，避免資方動輒以停扣會費手段干擾工會運作。勞委會統計，目前國內有883家企業工會，會員總數約54萬多人。
