| 樓梯間裝監視器 侵犯隱私判賠

一名林姓男子為了防盜，在居住的公寓4樓樓梯間架設監視器，去年間搬到公寓5樓的周姓男子和妻子，認為被監視，隱私權遭侵犯，向法院請求排除侵害；法院認定樓梯間屬住戶的私領域範圍，林架設監視器侵害了周的隱私權，判決林應將監視器拆除，並賠償4萬元給周。
判決書指出，林男住在某間5樓公寓的4樓，為了防小偷入侵，請保全公司在公寓4樓樓梯間架設2支監視器。
去年7月，周姓夫婦搬進5樓，只要出門就會被林男的監視器拍到，周男認為嚴重侵害其隱私權，和林協調未果，遂向法院提出排除侵害之訴，並要求張對其隱私侵害賠償80萬元。
法院認為，該公寓1樓有設大門，樓梯間為2到5樓住戶的私有財產，屬私領域範圍，非公共領域。而周男出入都須經過有架設監視器的樓梯間，林男的確侵害了周的隱私權，因此判決須將監視器拆除，而侵害隱私權時間為6個月，法院審酌張男收入，判決林應賠償4萬元為適當。
近年來，民眾為維護居家安全，在住處四周裝設監視器愈來愈多，但裝設是否一定會侵犯隱私？須視個案認定，一般而言，街頭巷尾的監視器因拍攝角度是針對公共區域，縱使拍攝到路人出入狀況，尚不致於有侵權疑慮。如果拍攝角度讓鄰居家人的出入狀況「全都錄」，就會因侵犯鄰居隱私而吃上官司。
