對人臉吐口水被控公然侮辱　判賠3萬元

【王吟芳／高雄報導】高雄一名黃姓男子因騎機車闖越紅燈，在路口遭楊姓女機車騎士指責，兩人爆發口角，黃竟惱羞成怒，朝楊女臉上接連「呸呸呸」的吐口水5 、6 次，楊女不滿提告並索賠10萬元精神慰撫金，高雄地院審結後判賠3萬元。

黃男到案時否認對楊女吐口水，辯稱只在兩人機車並排時朝地上吐痰，但因楊女指證歷歷，赴警局報案時還採集臉上唾液送驗，果真驗出黃男DNA，法院審理後認為兩人素不相識，若非黃男朝楊女臉上吐口水，應不可能留下生物跡證在楊女臉上，認定他確涉公然侮辱，刑事部分判處拘役45天，得以4萬5千元易科罰金，民事部分另判賠償楊女3萬元精神慰撫金，總計黃男要為吐口水行為付出7萬餘元代價。仍可上訴。
