| 法官不採DNA鑑定 評鑑認無重大過失

【丁牧群／台北報導】台北地院家事庭郭姓女法官遭當事人指控，3年前承審一件「生父死亡後認領」案件，郭命當事人驗DNA，結果顯示男原告與女被告的「半手足」(同父異母)關係屬「不可能」，但郭仍以「被繼承人(死者)與原告之母有同居關係且有撫育原告的事實」，判決被繼承人與原告有父子親子關係存在。
女被告不滿郭完全不採信DNA鑑定報告，甚至在判決書中隻字不提報告內容，向民間司改會投訴。由司改會向職務法庭提出法官評鑑案，但職務法庭調查認定，「半手足」關係的鑑定在科學上沒有絕對的「不可能」，且依據專家學者意見，應另加上其他親人的DNA鑑定才能確定血緣關係，而此案是難度較高的「同父異母」鑑定，在採樣不足(缺少父系親人參與鑑定)的狀況下，郭不採信DNA鑑定報告並無明顯重大違誤，可是郭在判決中沒有提到鑑定報告，仍有缺失，因此今決議本評鑑案不成立，僅移請台北地院提醒郭注意。
