內政部務會報24日通過「入出國及移民法」修正草案，明定移民署對強制驅逐出國的外國人，暫予收容期間不得超過15天，有繼續及延長收容必要時，應向法院聲請續予收容及延長收容，但總收容日數以120天為限。

據了解，對違法外國人強制驅逐的收容，過去曾發生過，有泰勞只需服刑3個月，卻因為法官裁判延宕，一拖就被關了400多天。監察院認為收容不是拘禁或羈押，要求司法院改善並請移民署正視此一議題。

內政部表示，這次修正「入出國及移民法」，主要是依大法官釋憲，外國人收容應符合「法官保留」原則意旨，因此修正明定移民署對強制驅逐出國的外國人，得暫予收容的期間不得超過15天。

內政部今天通過修法草案，外國人遣返前，暫予收容不得超過15日，若需續予及延長收容，應向法院聲請，總收容以120日為限。

2名外籍人士遭遣返前分別被內政部入出國及移民署收容90日及145日，2人於收容期間分別聲請釋憲。大法官會議2月做出釋字第708號解釋，認定入出國及移民法相關法條2年內失效。

內政部部務會報通過入出國及移民法部分條文修正草案，明定移民署對強制驅逐出國的外國人暫予收容期間不得超過15日，有繼續及延長收容必要時，應向法院聲請續予及延長收容。續予收容期間最長不得超過45日，延長收容期間最長不得超過60日，總收容日數以120日為限。

移民署副署長張琪表示，過去外籍人士遭收容，可能因沒護照、刑事官司沒結束，一再被延長收容，甚至超過2年、3年。

他說，修法後即使被收容的外籍人士在法院有案件或沒護照，將透過外籍人士在台親友、非政府組織或使領館具保，讓他出去，但每隔幾天，須向移民署專勤隊報到，證明沒逃逸。

內政部表示，草案將儘速報請行政院審查通過後，送立法院審議。
